Former Boise law firm partner censured for inappropriate behavior

In a recent development that has sparked discussions about workplace ethics, a former partner at a law firm in Boise, Idaho, has been publicly censured for his alleged inappropriate behavior involving sexual relations with an associate and a legal assistant. The incident, which took place at the office, led to a series of enticements in an attempt to keep the matter quiet.

The Idaho Supreme Court issued a public censure for W. Dustin Charters, the former partner at the center of the controversy, in a decision dated February 6. According to reports by the Idaho Statesman, Charters, who served as a mentor to the associate, offered monetary compensation and a reduced workload to both women in exchange for their silence about the incident.

The censure order revealed that the associate, who had recently joined the firm and was under Charters’ supervision, was just 26 years old at the time of the incident, while Charters was 37. Following the inappropriate behavior, Charters made offers to both women to dissuade them from reporting his actions. These offers included completing work for the associate that she could bill as her own time, as well as suggesting that she falsely bill his completed work as client development.

Despite the enticements, both women declined Charters’ offers and reported his behavior to the firm on September 26, 2023, just three days after the incident occurred. Subsequently, Charters was terminated from his position two days later.

A stipulation in the case noted that Charters had no prior disciplinary record and had taken responsibility for his misconduct. As part of the resolution, he underwent counseling and agreed to perform 100 hours of community service. Despite attempts to reach him for comment, Charters did not respond to requests from the ABA Journal.

The case highlights the importance of upholding ethical standards in the workplace and the need for accountability when those standards are breached. It also serves as a reminder of the courage displayed by the women who spoke out against inappropriate behavior, despite facing enticements to remain silent.
